Adjinaya Makeup Studio is a professional training organization specializing in professional makeup. Its head office is located at 5 rue de Lisbonne 93110 Rosny-sous-Bois. The organization is registered with DRIEETS D'Ile-de-France under number: 11930799993, and Qualiopi certified for training activities.

OBJECT :
These general conditions of sale apply to all training services. The fact of registering or placing an order implies full and unreserved acceptance of these general conditions of sale.

FINANCIAL CONDITIONS, REGULATIONS AND PAYMENT TERMS:
All prices are indicated in euros. Adjinaya Makeup Studio is not subject to VAT for professional training activities.
Payment of the price of the training must be made according to the conditions described in the contract or training agreement. In the event of a long journey, intermediate invoicing may be incurred.
Any amount not paid when due may automatically and without prior notice result in the application of penalties of an amount equal to the legal interest rate. Adjinaya Makeup Studio will have the option of obtaining settlement through litigation at the debtor's expense without prejudice to any other damages that may be due.

In the event of payment by the OPCO on which the customer depends, that is to say the natural or legal person who places the order, or by any other external financing organization, it is up to the latter to make their request for payment. in charge before the start of the training. Support for the request for financial support for training can be provided by Adjinaya Makeup Studio or its partners. The funding agreement must be communicated at the time of registration. In the event of partial coverage by an external financing organization, the difference will be directly invoiced to the client, who undertakes to ensure payment before the start of the training. If the support agreement does not reach Adjinaya Makeup Studio at the latest 7 days before the start of the training, the training center fully reserves the right to refuse the trainee's entry into the training or to invoice the full amount. training costs to the customer. In exceptional situations, payment may be made in installments. In any case, its terms must have been formalized before the start of the training.

CANCELLATION AND REPLACEMENT OF A PARTICIPANT:
In the event of withdrawal notified by the client to Adjinaya Makeup Studio at least 7 days before the start of the training, Adjinaya Makeup Studio offers the possibility:

• to postpone the trainee's registration for subsequent training,
• to replace the trainee with another participant with the same profile and the same training needs.

CANCELLATION, ABSENCE OR INTERRUPTION OF TRAINING:
Any training started is due in full and will be billed to the client. In the event of absence, interruption or cancellation, invoicing will distinguish the price corresponding to the days actually attended by the trainee and the sums due for absences or interruption of training. Please note that the amounts owed by the client in this respect cannot be charged against their obligation to participate in continuing professional training nor be the subject of a request for reimbursement by an external financing organization.
In this case, the customer undertakes to pay the sums which remain his responsibility directly to Adjinaya Makeup Studio.

HOURS AND WELCOME:
For all training courses, the location, address, times and reception conditions are indicated before the training.

STAFF AND ADJOURNMENT:
To promote the best learning conditions, the number of students in each training course is limited. This number is determined, for each training course, based on the objectives and teaching methods.
Registrations are taken into account in their order of arrival. Issuing a quote does not constitute registration. Only quotes duly provided, dated, signed, marked “Good for agreement” and returned to Adjinaya Makeup Studio have contractual value. Once the number is reached, registrations are closed.

Adjinaya Makeup Studio can then offer participation in a new session, or to appear on a waiting list.
In the event that the number of participants is insufficient to ensure the smooth running of a training course, Adjinaya Makeup Studio reserves the right to postpone the training at the latest one week before the scheduled date and without compensation.

QUOTE AND CERTIFICATE:
For each training action, a quote is sent to the client. It must be duly completed, dated, signed, marked “Good for agreement”, and returned to Adjinaya Makeup Studio by any means at the customer's convenience: hand delivery, email, post.
A contract or training agreement is established between Adjinaya Makeup Studio and the OPCO or the client.
At the end of the training, Adjinaya Makeup Studio provides a training certificate to the trainee. In the case of partial or total coverage by an OPCO or other external financing organization that requires it, Adjinaya Makeup Studio sends a copy of this certificate, accompanied by the invoice.
A certificate of attendance for each trainee can be provided to the client, upon request.

OBLIGATIONS AND FORCES MAJEUR:
As part of its training services, Adjinaya Makeup Studio is bound by an obligation of means and not of results towards its clients or its trainees.
Adjinaya Makeup Studio cannot be held responsible towards its clients or its trainees in the event of non-performance of its obligations resulting from a fortuitous event or force majeure. Here considered as a fortuitous event or force majeure, in addition to those usually recognized by case law: the illness or accident of a teacher or educational manager, strikes or external social conflicts, natural disasters, fires, interruption of telecommunications, energy supply, or transportation of any type, or any other circumstance beyond the reasonable control of the training organization.

INTELLECTUAL PROPERTY AND COPYRIGHT:
All contractual documents, presentation sheets, content and educational supports whatever their form (paper, electronic, digital, oral, etc.) used by Adjinaya Makeup Studio to provide training, or given to trainees, constitute original works and as such are protected by intellectual property and copyright.

As such, the client and the trainee undertake not to use, transmit, reproduce, exploit or transform all or part of these documents, without the express agreement of Adjinaya Makeup Studio. This prohibition relates, in particular, to any use made by the client and the trainee for the organization or delivery of training.

DESCRIPTION AND PROGRAM OF TRAINING:
The contents of the programs, as broadcast on all types of media, are provided for information purposes only. The speaker or educational manager reserves the right to modify them according to current events, the level of the participants or the dynamics of the group.

CONFIDENTIALITY AND COMMUNICATION:
Adjinaya Makeup Studio, the client and the trainee undertake to keep confidential the documents and information to which they may have access during the training provision or during exchanges occurring prior to registration. Adjinaya Makeup Studio undertakes not to communicate to third parties other than the partners with whom the training is organized and to external funding organizations, the information transmitted by the client, including information concerning the trainees, unless they agree.
However, the client agrees to be cited by Adjinaya Makeup Studio as a client of its training courses. To this end, the client authorizes Adjinaya Makeup Studio to mention its name as well as an objective description of the nature of the services in its reference lists and proposals for the attention of its prospects and customers, interviews with third parties, reports activity, as well as in the event of legal, regulatory or accounting provisions requiring it.

CONFIDENTIALITY AND COMMUNICATION:
The client undertakes to inform each trainee that:

• personal data concerning him or her are collected and processed for the purposes of monitoring the validation of training and improving the Adjinaya Makeup Studio offer
• In accordance with Law No. 78-17 of January 6, 1978, the trainee has the right to access, modify and rectify personal data concerning him or her. APPLICABLE LAW AND COMPETENT JURISDICTION:
The general conditions detailed in this document are governed by French law. In the event of a dispute arising during the interpretation of these terms or the execution of the contract, an amicable solution will be sought.
Failing this, the Courts of Bobigny will have sole jurisdiction to resolve the dispute.
